Imran Khan demands inquiry against retired Gen Bajwa over 'oath violation'

Pakistan Tehreek-e-Insaf (PTI) Chairman and former prime minister Imran Khan on Thursday requested President Arif Alvi, who is also supreme commander of the armed forces, to initiate an inquiry against former Chief of Army Staff (COAS) retired Gen Qamar Javed Bajwa over his alleged involvement in his ouster.

The PTI chief has been accusing the former army chief of playing a key role in toppling the PTI government since he failed to obtain a no-confidence vote from the National Assembly in April last. The campaign got pace in November last after retired Gen Bajwa hung the boots as Mr Khan openly slammed him for derailing a democratic set-up through a conspiracy. 

Mr Khan has sent a letter to President Alvi, highlighting that some recent information surfaced on media proved that Mr Bajwa as COAS “violated his oath of office repeatedly”. In the letter, Mr Khan referred to an article of journalist Javed Chaudhry wherein the latter had written about his conversation with the former army chief.

“He [Mr Bajwa] has admitted to journalist Javed Chaudhry that ‘we’ (and it would be critical to ascertain from him who was the ‘we’ in reference to) considered Imran Khan dangerous to the country if he continued to stay in power,” Mr Khan told the president in the letter.

“The question that arises is who gave him the power to decide that an elected PM was supposedly a ‘danger to the country if he continued to stay in power’. Only the people through elections can decide who they want to elect as PM.” “Taking such a right on himself is in clear violation of his oath as given in Third Schedule Article 244 of the Constitution,” he stressed. 

The PTI chief said retired Gen Bajwa had also admitted his role in dismissal of a NAB case against former finance minister Shaukat Tarin. “…he managed to get NAB case against Shaukat Tarin dismissed revealing that NAB was under his control,” reads the letter. 

The former premier said it was also a clear violation of the Constitutional oath because “the army itself is a department under the Ministry of Defence and civilian autonomous institutions do not come military control”.

“According to a Vlog of a Pakistani journalist Aftab lqbal, Gen Bajwa told him in conversation that he had tapes of then PM Imran Khan’s conversations with him. This is a serious violation again of his oath and violation of fundamental human rights. The question is why and under what authorisation was Gen Bajwa recording confidential conversations?” the letter said.

He alleged that Mr Bajwa as COAS also committed another serious violation of his oath when he publicly went against the then government’s policy of maintaining neutrality in the Russia-Ukraine war. “He [Bajwa] did this at an international conference in Islamabad on April 2, 2022 – the Islamabad Security Conference,” he said.

Imran Khan, who is currently facing multiple cases in courts, said it was constitutional duty of the president and as supreme commander of the armed forces to “take immediate action and institute an inquiry so as to establish whether such grave violations of the Constitution and oath of Office under the Constitution have taken place”.

The Pakistan Tehreek-e-Insaf (PTI) founder says he is ready to face an inquiry into the 2014 sit-in.

The PTI founder, who interacted with reporters at Adiala Jail a day after the ISPR presser, said he would be happy to appear before an inquiry committee. He said the allegations levelled against him regarding the dharna (sit-in) were wrong.

He said the 2013 election was the one of returning officers (ROs).

“How can one hold dialogue with the government after the caretaker prime minister’s statement about Form 47,” he said while calling the elections of prime minister, president, Punjab chief minister and Senate bogus.

Holding out an olive branch to the powers that be, he said half of his family had men in army and half bureaucrats. “This is our army and we have no issue with it. I came to know about the May 9 violence when I appeared in the Supreme Court,” he said.

He said he condemned the May 9 violence while being in the court of Justice Umar Ata Bandial.

The army, he said, should not be dragged in politics. “We have not resorted to arson in our 27-year history,” he said.

He said the PTI dissolved two governments. It did not want violence, he added.

The PTI founder’s media talk holds significance as it comes a day after Inter-Services Public Relations (ISPR) Director General Maj Gen Ahmad Sharif Chaudhry’s presser.

The ISPR once again said the perpetrators and facilitators of May 9 violence would have to face punishment in line with law and Constitution. The army, he said, had the evidence of wrongdoing.

He said May 9 was not Pakistan armed forces’ case but it was a case of all Pakistanis. An attempt was made to create hatred between the people of the country and armed forces, he said, adding that it’s essential to punish the perpetrators to keep faith in the judicial system intact.
