Short-term relief for Fawad Chaudhry as IHC allows two-week foreign travel

The Islamabad High Court on Tuesday ordered to remove the name of former information minister Fawad Chaudhry from the no-fly list temporarily. The IHC allowed him foreign travel of two weeks.

IHC Chief Justice Aamer Farooq passed the order on the petition filed by Fawad Chaudhry, allowing him to proceed abroad between Aug 10 and 24.

Meanwhile, the Deputy Attorney General has sought time from court to submit reply in this regard.

Govt takes action against MNA Adil Bazai for skipping vote on 26th amendment

Following his absence from an all-important session of the lower house which oversaw the passing of 26th amendment, the government on Monday took a strict action against MNA Adil Bazai.

National Assembly Speaker wrote another letter to the ECP demanding that the MNA be disqualified and his seat made vacant.

It should be noted that PML-N President Nawaz Sharif sent a reference against Bazai to the speaker as he was absent from the NA session.

Adil Khan Bazai is a member of PML-N and he did not cast vote over the 26th amendment.

ICJ describes 26th amendment as threat to judicial independence in Pakistan

The International Commission of Jurists (ICJ) has described the passage of 26th Constitutional Amendment as a blow to judicial independence, the rule of law, and human rights protection in Pakistan.

In a statement issued on Monday, the ICJ Secretary General Santiago Canton said, “These changes bring an extraordinary level of political influence over the process of judicial appointments and the judiciary’s administration.”

“They erode the judiciary’s capacity to independently and effectively function as a check against excesses by other branches of the State and protect human rights.

“It is alarming a Constitutional Amendment of great significance and public interest was passed in such a secretive manner and in less than 24 hours.

“The core principle of the rule of law and the separation of powers according to which citizens and their freely chosen representatives have the right to participate in the legislative process culminating in the adoption and enactment of laws was flagrantly violated in this case,” added Canton.

The ICJ is particularly concerned about the following changes introduced by the 26th Constitutional Amendment since they seriously undermine the independence of the judiciary by unduly subjecting it to executive and Parliamentary control.

These amendments directly violate Article 14 of the International Covenant on Civil and Political Rights (ICCPR), which guarantees the right to equality before courts and tribunals and to a fair and public hearing by a competent, independent and impartial tribunal established by law. Article 10A of Pakistan’s Constitution also recognizes the right to a fair trial.

“The ICJ understands that some reforms to the existing judicial system may have been needed to make the courts more efficient and accountable, and the judicial appointment process more transparent and inclusive,” said Santiago Canton.

“But these amendments are an attempt to subjugate the judiciary and bring it under the control of the executive, betraying fundamental principles of the rule of law, separation of powers and the independence of the judiciary,” he added.

Punjab govt launches 'Dhee Rani' programme for underprivileged couples

Punjab CM Maryam Nawaz has launched ‘Dhee Rani’ programme to arrange the wedding ceremonies of underprivileged couples and ease their burden. 

The applications under this project can be submitted through the online portal cmp.punjab.gov.pk and helpline 1312. 

On the direction of the Punjab CM, a helpline number had been made to answer any queries. 

Teams would visit the homes of aspirants to verify the eligibility to ensure transparency and fairness in the programme.

The new couple will be given Rs100,000 through ATM cards and essential furniture, crockery and clothes. 

The government will also arrange meals in the wedding ceremony of the couples. 

AMENDMENT WOULD ENSURE TIMELY JUSTICE 

The Punjab CM hailed the 26th amendment to the constitution and congratulated the nation saying it would ensure timely justice. 

She emphasised that the amendment was inevitable for supremacy of law and it had restored parliament’s constitutional powers and sanctity. 

Maryam Nawaz insisted that positive reforms would be made in the judicial system and the judiciary would be more independent and strengthened.

She also hailed an article on the eradication of interest in Pakistan.
